The 2014 ISAE Legislative Committee is monitoring and tracking the bills submitted for consideration during this legislative session, and has met and taken action to oppose two based on the consensus of the committee. A short priority list below is followed by the complete list of bills being tracked this session:

 

HB4317 (Drury, Franks) Lobbyist Registration.

 

Oppose.  Looks to be targeting a particular situation, declares that lobbying records should generally be available to the public, and work records related to lobbying are not shielded by the attorney-client privilege solely. Requires every lobbying entity to report billings to clients, which includes the amount billed, the client billed, and the time frame in which services were performed.  (Re-referred to Rules Committee)

 

HB5618 (Fortner) Local Govt - Hotel Tax Uses

 

Recommendation to Track and Monitor on behalf of our industry partners. Amounts collected by a county from a hotel tax shall be expended to promote transportation for tourists and infrastructure for transportation for tourists.  Not a new tax, only expands possible usage of existing taxes for tourism related items.  (Re-referred to Rules)

 

HB5875 (Yingling) FOIA - Public Body Definition

 

ISAE Opposed and Randy Witter talked with Rep. Yingling March 24. Sponsor does not plan to call the bill this session and ISAE will continue to track. Freedom of Information Act. Provides that "public body" includes any State-wide organization which receives 75% or more of its funding through contributions from taxing bodies for the sake of membership or dues in order to participate in the organization's activities, including, but not limited to, educational endeavors, legislative initiatives, or a general liability insurance pool. Opposed by more than three dozen organizations. (Re-assigned to Rules)

 

SB2593 (Steans, et al.) LLC Fee Schedule

 

Recommendation to Monitor. Reduces some fees in the fee schedule for limited liability companies filing documents with the Secretary of State to match the fees for similar documents in the fee schedule for corporations. (Still in Assignments)

 

SB2722 (Hastings) Sec of State - Lobbyist ID

 

Rumor is that this will be the omnibus lobbyist bill.  Currently set to narrow the focus from ALL boards, commissions, authorities, or task forces (over 300 people) to only those who that have the authority to make binding recommendations or determinations (30-50 people).  Some others take issue with this, and actually want language expanded to include family members of a person on a board, etc.  This is obviously problematic when you don't know if someone's family member is on an non-relevant board, and a number of other scenarios. 

Furthermore we would like to add our own language to this bill removing our requirement to file 0's every two weeks.  We even offered to increase the fines if a lobbyist neglects to report an actual expenditure.    As an FYI, in 2013 of the 1655 late filings, 1622 were $0.  At $50 a violation, this is over $80k in fines.

Finally, we also heard that headway may have been made on the credit card processing fee. We have heard rumors that the charge may drop from $11 to a 2.35% fee (which would be closer to $7 on our $300 registration, and only $1.18 for a $50 late fee).

We are going to push for a meeting with all interested parties.  (Placed on calendar, order of second reading April 1. 2014)

 

Lobby Day

 

Our recommendation is that the second year of a general assembly with shorter schedules and "emergency only" legislation isn't the best environment to attempt a lobby day.  We will revisit this issue soon and discuss the possibility of hosting an event in 2015.
